§ 1 Preliminary Provisions

The following Terms and Conditions define the rules and regulations governing transactions made through the Polmar Profil online store. The use of the Online Store may only take place in accordance with the rules and scope indicated in these Terms and Conditions. The Polmar Profil online store, available at www.soteshop.polmarprofil.pl, is operated by Polmar Profil Sp. z o.o., headquartered in Lubliniec (ul. Powstańców Śląskich 64, 42-700 Lubliniec), entered into the Register of Entrepreneurs of the National Court Register (KRS) under the number: 0000129946, holding the NIP (Tax Identification Number): 5751748003 and REGON: 152078599. The content of the Terms and Conditions is continuously and freely available on the store's website in a way that allows Customers to obtain, read, and retain its content by printing or saving it on a storage device at any time.

§ 2 Definitions

  • Consumer: A Customer who is a natural person using or interested in using the Service, being a consumer within the meaning of Article 22[1] of the Civil Code (a natural person performing a legal transaction not directly related to their business or professional activity).

  • Entrepreneur: A Customer who is an entrepreneur within the meaning of Article 43[1] of the Civil Code.

  • Price: The price expressed in Polish zloty (PLN). The Product price is given inclusive of VAT (gross price). The price does not include Delivery Costs.

  • Registration Form: A form available in the Store that allows the creation of an Account.

  • Order Form: An interactive form available in the Store that allows placing an Order, specifically by adding Products to the Cart and defining the terms of the Sales Agreement, including delivery and payment methods.

  • Customer: A person making purchases through the Store.

  • User Account (Account): The customer's account in the Store, which stores data provided by the Customer and information about Orders placed by them in the Store.

  • Delivery Costs: The costs of delivering Products covered by a confirmed Order to the address indicated by the Customer.

  • Cart: A software component of the Store where the Products selected by the Customer for purchase are visible, and where it is possible to determine and modify Order details, especially the quantity of Products.

  • Product: A movable item available in the Store that is the subject of a Sales Agreement between the Customer and the Seller.

  • Terms and Conditions: These regulations of the Store.

  • Seller: Polmar Profil Sp. z o.o., ul. Powstańców Śląskich 64, 42-700 Lubliniec, entered into the National Court Register (KRS) under the number: 0000129946.

  • Online Store (Store): The online store run by the Seller at the internet address www.soteshop.polmarprofil.pl.

  • Sales Agreement: A product sales agreement concluded between the Customer and the Seller via the Online Store.

  • Order: The Customer's declaration of intent submitted via the Order Form, aimed directly at concluding a Sales Agreement for a Product or Products with the Seller. Orders are placed by adding a product to the cart and then clicking the "Confirm order" button. To successfully complete the order process, it is necessary to create a user account via the Registration Form, which also allows tracking the order status.

§ 4 General Information

To the fullest extent permitted by law, the Seller is not liable for disruptions, including interruptions in the functioning of the Store, caused by force majeure, unauthorized actions of third parties, or incompatibility of the Online Store with the Customer's technical infrastructure. Browsing the Store's assortment does not require creating an Account. Placing orders by the Customer for Products in the Store's assortment is possible after creating an Account in accordance with § 5 of the Terms and Conditions. Prices given in the Store are in Polish zloty and are gross prices (including VAT). The final amount to be paid by the Customer consists of the Product price and the delivery cost (including transport, delivery, and postal/courier fees), about which the Customer is informed on the Store's pages during the Order placement, including at the moment of expressing the will to be bound by the Sales Agreement. Using the Online Store is possible provided that the ICT system used by the Customer meets the following minimum technical requirements: a computer or mobile device with Internet access, access to email, a web browser with JavaScript and cookies enabled, and a program to read PDF files. The Customer's obligations include: not using the Store in a manner violating the law, good practices, or personal rights; respecting intellectual property rights; not interfering with the Store's functioning; not sending spam; and properly using the Goods.

§ 5 Creating an Account in the Store

To create an Account in the Store, the Registration Form must be filled out. It is necessary to provide the following data: First Name, Last Name, Address, Phone Number, and E-mail address. Creating an Account in the Store is free of charge. Logging into the Account is done by entering the login and password established in the Registration Form. The Customer may, at any time, without giving a reason and without incurring any fees, delete the Account by sending a relevant request to the Seller (via email or in writing).

§ 6 Rules for Placing an Order

Information about the Goods provided on the Store's website constitutes an invitation to conclude an Agreement, within the meaning of Article 71 of the Civil Code. All Goods available on the Store's website are new and free from physical and legal defects. Having an Account is a prerequisite for placing an order. The Order is placed with the Seller by the Customer in electronic form and constitutes an offer to conclude a Sales Agreement. The Sales Agreement is concluded upon the Customer's receipt of the declaration of acceptance of the Order for execution. The Seller will provide a receipt or VAT invoice along with the Goods. The Customer is obliged to provide correct details for the invoice. To place an Order, one must: add the Product to the Cart, click "Confirm order", log in or fill in delivery details, click "Order and pay", and select a payment method. Orders placed on weekdays after 13:00, on Saturdays, Sundays, and public holidays will be processed on the next business day. The Seller does not accept parcels sent at the Seller's expense or cash-on-delivery parcels (e.g., for returns).

§ 7 Offered Delivery and Payment Methods

The Customer may use the following delivery or collection methods: Courier delivery, cash-on-delivery courier, delivery to parcel lockers, or personal collection at the company's headquarters. The Customer may use the following payment methods: Payment on collection, cash on delivery, bank transfer to the Seller's account, or quick online electronic payments.

§ 8 Execution of the Sales Agreement

The conclusion of the Sales Agreement occurs after an Order is placed via the Form in the Store. If payment by bank transfer or online payment is selected, the Customer is obliged to make the payment within 7 calendar days. In the case of cash on delivery / payment on collection - at the time of delivery / collection. The Product will be dispatched by the Seller within the timeframe indicated in the description. In the case of ordering Products with different delivery times, the longest stated timeframe applies as the delivery date. Delivery costs apply exclusively to the territory of Poland. In other cases, costs and conditions are agreed upon individually. Delivery is subject to a fee; personal collection is free of charge.

§ 9 Right of Withdrawal from the Agreement

The Consumer may withdraw from the Sales Agreement within 14 days without giving any reason. The timeframe begins upon the delivery of the Goods to the Consumer. The declaration may be sent by traditional mail, by e-mail (polmar@polmarprofil.pl), or submitted in person. Consequences of withdrawal: The Seller shall refund payments to the Consumer no later than 14 days from receiving the declaration. The Seller will refund the payment using the same payment methods used by the Consumer. The Consumer is liable for any diminished value of the Goods resulting from using them in a manner other than what was necessary. The right to withdraw from a distance contract does not apply, among others, to non-prefabricated items manufactured according to the consumer's specifications or intended to meet their customized needs (e.g., custom-cut products).

§ 10 Complaints

The Seller is obliged to provide the Customer with a defect-free item. The Seller is liable to the Consumer under the statutory warranty for defects (rękojmia) on the principles set out in Articles 556 – 576 of the Civil Code. Complaints can be submitted in writing by registered mail to the Seller's address, by email (polmar@polmarprofil.pl), or via the contact form. To process a product complaint, the Customer should send or deliver the complained-about Good to the Seller's address. The Seller will process the complaint within up to 14 calendar days.

§ 11 Entrepreneurs

The provisions of this paragraph apply exclusively to Customers who are Entrepreneurs. A Customer who is an Entrepreneur does not have the right to withdraw from the Agreement with the Seller (with the exception of Entrepreneurs operating with consumer rights). Upon handing over the Products to the carrier, the benefits and burdens associated with the Products, as well as the risk of their loss or damage, transfer to the Entrepreneur. Upon receiving the Products, the Entrepreneur is obliged to inspect their condition in the presence of the carrier. With regard to Entrepreneurs, liability under the statutory warranty for defects (rękojmia) is excluded.

§ 12 Personal Data

The Controller of the Customers' personal data is the Seller - Polmar Profil Sp. z o.o. Customers' personal data are processed exclusively for the purpose of executing the Agreement (legal basis: Article 6(1)(b) of the GDPR). The Customer has the right to access, rectify, delete, or restrict the processing of data, as well as the right to lodge a complaint with a supervisory authority. The personal data provided by Customers are collected and processed by the Seller in accordance with applicable legal regulations and the Privacy Policy.

§ 13 Out-of-court Complaint and Redress Mechanisms

The Consumer has the right to use out-of-court dispute resolution methods. Information is available at the offices and on the websites of consumer ombudsmen, Provincial Inspectorates of the Trade Inspection, and the Office of Competition and Consumer Protection (www.uokik.gov.pl). The Consumer may use the ODR platform, which is available at http://ec.europa.eu/consumers/odr.

§ 14 Final Provisions

Agreements concluded via the Online Store are concluded in Polish. The content of these Terms and Conditions may change. Information about a change in the terms will be posted on the Service with at least 14 days' advance notice. In matters not covered by these Terms and Conditions, generally applicable provisions of Polish law shall apply.
